SUMMARY
This ordinance amends Code of Ordinances Chapter233- Cable Television to provide for the granting of a non-exclusive cable television franchise to Spectrum Mid-America in addition to the existing franchise to Limestone Cable Vision, Inc. It sets the term of the franchise at eight years and it regulates a minimum provision for customer service.
This ordinance amends Code of Ordinances Section 54.02 to change the regular meeting time of the fourth Thursday of the month to 11:00 a.m.

ORDINANCE ADOPTING THE ASSESSMENT OF THE MASON COUNTY PROPERTY VALUATION ADMINISTRATOR FOR REAL AND PERSONAL PROPERTY AND SETTING AD VALOREM TAX LEVIES AND LEVYING FRANCHISE TAX ON FINANCIAL INSTITUTIONS
WHEREAS, the 2024 ad valorem tax rate on motor vehicles is fixed by KRS 132.487(2) at the rate which could have been levied on 1 January 1983 assessments; and
WHEREAS, the Board of Commissioners hereby foregoes any other ad valorem tax increases for 2023 which would result from raising the tax rate, as authorized by KRS 132.027.
NOW THEREFORE BE IT ORDAINED BY THE CITY OF MAYSVILLE as follows:
- That the assessment of real and personal property made by the Mason County Property Valuation Administrator, reviewed by the Mason County Board of Assessment Appeals, equalized and certified by the Kentucky Revenue Cabinet, and certified by the Mason County Clerk to the City Treasurer as set out below is hereby accepted and adopted as the assessment of taxable property in the City of Maysville for tax year 2023, which assessment shall be subject to taxation at the rates to be fixed by Ordinance.

- That ad valorem taxes shall be levied on all real property for 2023 as shown by the aforesaid assessment, and shall be levied on all real property commencing with the tax year 2023 and thereafter, for residents of the City of Maysville and the tax rate for the tax year is set and established at $0.158 per one hundred dollars of valuation pursuant to KRS 92.280 and 132.07,
- That there is levied a franchise tax at the above rate on financial institutions equal to 0.025 percent of deposits in such institutions located within and taxable by the City, to be billed by the City Clerk by 1 December 2023 and due with two percent discount if paid by 31 December 2023 or without discount if paid by 31 January 2024, pursuant to KRS 136.575.
- That the tax rate for motor vehicles is set and established at $0.2460 per $100.00 of assessed value taxable in the City in 2024, pursuant to KRS 132.487.
- That the purpose of said taxes is fixed, set, established and levied for general revenues and all moneys are to be paid to the City of Maysville same to be paid into the general revenue fund of the said City of Maysville.

AN ORDINANCE AMENDING THE ADOPTED SALARY SCHEDULE FOR CLASSIFIED
Summary
This Ordinance amends the salary schedule for regular City employees and non-elected officials by job classification to add a Fire Department position titled EMS Operations Manager with a minimum rate of $24.00 per hour and a maximum rate of $30.00 per hour.
AN ORDINANCE OF THE CITY OF MAYSVILLE IN MASON COUNTY KENTUCKY ESTABLISHING A SCHOOL ZONE WITH TRAFFIC CONTROL DEVICES AND SPEED LIMITS SUMMARY
This Ordinance establishes a school zone for a portion of Limestone Street and Kentucky Highway 2516 (Fourth Street) and establishes a 15 mph speed limit in the school zone, as well as a portion of Martha Comer Drive and establishes a 25 mph speed limit in this school zone.

AN ORDINANCE AMENDING
Summary
This Ordinance amends TITLE XIX-Private Property Regulations Chapter 190.- Noise Article 1 Section 190 to add Section 190.26 which regulates the use of consumer fireworks by prohibiting same from being detonated except on (a) December 31 from 10:00 a.m. until January 1, 12:30 a.m.
(b) July 4 from 10:00 a.m. to 11:30 p.m. and (c ) July 3 and July 5 from 10:00 a.m. to 11:00 p.m.; It requires an application for a permit on other days from the Police Chief; It sets forth the permitting process; and it prohibits use of fireworks on public property.
Summary
This Ordinance amends Title XVII-Public Ways and Property Chapter 176-Construction of Public Streets to add Section 176.08 regulating the creation and installation of speed humps on City Streets. It allows installation of speed humps in residential areas only; it provides that speed humps will not be installed unless 70% of affected property owners are in favor them; It sets forth the procedures for requesting, verifying and approving speed humps; It sets forth criteria for location of speed humps and requires the Petitioner to obtain the necessary signatures from adjoining property owners; It provides that warning signs shall be placed warning motorists of the speed humps and it makes the removal process the same as the application process.

This ordinance changes Code of Ordinances Section 150.61 Water Deposits to exempt property owners in good standing for 5 years or length of active service if less than 5 years from the requirement to pay a deposit when transferring service from their existing personal residence account to a new personal residence account, and to eliminate references to interest on deposits.

SUMMARY
This Ordinance adopts and affirms the Findings of Fact, Conclusions of Law and Recommendations of the Mason County Joint Planning Commission pertaining to the siting, development, construction, installation, and decommissioning of Solar Energy Systems (“SES”) in the City of Maysville with changes. It creates an amendment to City of Maysville Ordinance Chapter 320 to create Section 320.415 regulating solar energy systems. This section prohibits large scale SES within the incorporated limits of the City of Maysville and allows and regulates integrated, roof top and small scale ground mounted SES and intermediate scale ground mounted SES. This ordinance provides the definitions for terms used within the ordinance, provides district regulations, setback requirements, safety design and installation standards, provides regulation for operation and maintenance, addresses screening and buffering plans, addresses a decommissioning plan, addresses liability insurance and environmental insurance, provides for application procedures and gives preconstruction and post construction requirements. It changes setback requirements for Non Large Scale Secondary use SES and allows for Net Metering on those SES. Its changes the noise limits on SES located within the City of Maysville to comply with City of Maysville Code of Ordinances Section 190. It provides for water runoff, soil scouring, erosion and contamination to be managed from design through decommissioning of the project.
- Complaint Procedure
- If after sixty (60) days there is no resolution of a registered complaint the complainant may provide notice to the Planning and Zoning Administrator accompanied by a fee of $250.00 that they intend to enter into binding arbitration of the unresolved complaint. Failure by the operator to perform an action specified by the arbitrator will be considered a violation of the zoning ordinance and subject to the applicable enforcement penalties and remedies. Upon receipt of a request for arbitration the Planning and Zoning Administrator will arrange for a time and place to meet with the arbitrator. Upon approval of a SES project the operator shall continually fund a non-reverting fund (for arbitration only), which will contain no less than $5,000 dollars at any time, for the life of the SES project. Notification by Certified Mail of a deficiency in the balance of the fund to the operator shall be the responsibility of the Planning and Zoning Administrator. If upon notification that the fund is deficient, the operator shall have sixty (60) days to bring the fund back to the prescribed minimum amount. If the payment is not satisfied within the sixty (60) days, the SES project will be deemed in violation of the permit. The arbitrator shall be a member of the Kentucky Bar Association, be on the Roster of Court-Approved Mediators in the State of Kentucky and not be a citizen of the City of Maysville or Mason County, Kentucky. The Planning and Zoning Administrator may appear and present evidence on behalf of a complainant if requested to do so.
Summary
This Ordinance amends Code of Ordinances Chapter 320.406.6 to prohibit Large Scale Solar Energy System (SES) in the City of Maysville to permit Integrated and Rooftop SES, to allow Small Scale SES except in TH-1 and D-1, and permit Intermediate Scale SES in A-1, A-2, 1-1, 1-2 and I-3.
WHEREAS, the Maysville-Mason County Joint Planning Commission held public hearings on November 16 and 18, 2021, March 2, 2022 and May 4, 2022 concerning the proposed changes in Chapter 320; and
WHEREAS, the Maysville-Mason County Joint Planning Commission adopted Findings of Fact, Conclusions of Law, and the Board of Commissioners discussed changes in an open meeting;

SUMMARY
This ordinance changes Code of Ordinances Section 152.07 to change the monthly fee of $13 per month to fee will be based on fee assessed by the contractor for garbage collection and will be included with the monthly water and sewer bill and collected at the same time.

The following Ordinances were adopted by the Board of Commissioners of the City of Maysville, Kentucky Dec. 29, 2022:
This Ordinance amends Code of Ordinances Section 137.02 to expand the transient room tax to include stays at campgrounds and recreational vehicle parks. It further requires those facilitating the rental of accommodations to collect the room tax on their total charges for the rental of accommodations. It further exempts receipts from a customer for a continuous stay of thirty days or more. Finally, it requires online platforms that facilitate rentals to report and pay the local transient room tax based upon total charges for rentals, including service fees.
This Ordinance amends Code of Ordinances Chapter 154 to create §154.079 to regulate persons who transport domestic wastewater. It establishes a charge for wastewater haulers to obtain permits and establishing a fee of $40 for each 1000 gallons of domestic wastewater (sewage) discharge by wastewater haulers. It further establishes billing procedures for such charges, establishes a discharge point for use by any wastewater hauler, sets time parameters for discharge, and establishes causes for termination and/or suspension of a discharge permit. It further sets forth the information required on a wastewater hauler trucker’s discharge permit application. Finally, it amends subsection 154.074 to delete duplicative language.
